Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ReadyPillar.ai platform ("ReadyPillar," "Service," "we," "us," or "our"), including the web application, assessment tool, report generation service, and all associated APIs. By creating an account or using ReadyPillar, you agree to these Terms. If you do not agree, do not use the Service.

Definitions

  • "Assessment" means the AI readiness scoring questionnaire you complete through the Service.
  • "Report" means the PDF or web-based analysis generated from your Assessment results, available in Template, Starter, and Pro tiers.
  • "User Content" means any data you submit to the Service, including your Assessment answers, organizational profile information, and account details.
  • "AI-Generated Content" means the narrative analysis in Starter and Pro tier Reports that is produced by large language models.

1. Service Description and Eligibility

1.1 What ReadyPillar Provides

ReadyPillar is an online AI readiness assessment tool that computes a scored evaluation of an organization's AI adoption readiness across six pillars: Data Readiness, Strategic Alignment, People & Skills, Infrastructure, Governance & Ethics, and Process Maturity. We offer PDF report generation in three tiers and optional benchmarking against anonymized peer data.

1.2 Eligibility

  • You must be at least 18 years old to use the Service.
  • If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
  • The Service is intended for business use only and is not designed for consumer or personal use.

1.3 Account Responsibilities

You must provide accurate information when registering. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at support@readypillar.ai if you suspect unauthorized access.

2. Assessment and Report Terms

2.1 Nature of Assessment

The ReadyPillar scoring algorithm is a deterministic, weighted scoring model. Results reflect your self-reported answers at the time of the Assessment. ReadyPillar does not verify the accuracy of your answers; your score is only as accurate as the information you provide.

2.2 AI-Generated Report Disclaimer

Starter and Pro tier Reports are generated using artificial intelligence language models. AI-generated content may contain errors, omissions, outdated information, or content that does not apply to your specific circumstances. Reports are provided for general informational and educational purposes only. They do not constitute professional consulting advice, legal advice, financial advice, IT strategy advice, or any other form of professional advisory service. You should not rely solely on any Report as the basis for business decisions. We strongly recommend engaging qualified professionals before implementing any recommendations.

2.3 Template Reports

Template reports ($9) use pre-written content blocks mapped to your score ranges. They do not involve AI generation. The same informational-only disclaimer applies.

2.4 Accuracy Limitation

Neither the score nor the Report constitutes a certification, audit, guarantee, or warranty of any kind regarding your organization's AI capabilities or readiness. Maturity level designations (e.g., "AI-Embedded") are internal classification labels only, not industry-standard certifications.

3. Payment Terms

All prices are in USD. Applicable taxes (VAT, GST, sales tax) will be calculated and displayed at checkout.

3.2 Payment Processing

Payments are processed by Dodo Payments. By completing a purchase, you also agree to Dodo Payments' terms of service. ReadyPillar does not store your payment card information.

3.3 Refund Policy

All purchases are non-refundable except as required by applicable law or as stated below:

  • If report generation fails due to a platform error and we cannot deliver a Report within 72 hours, you are entitled to either redelivery or a full refund.
  • EU/UK consumers: By clicking "Purchase and Generate Report," you consent to immediate delivery of digital content and acknowledge that your statutory 14-day right of withdrawal is waived upon delivery, in accordance with the EU Consumer Rights Directive.

4. Intellectual Property

4.1 Platform IP

All rights in the ReadyPillar platform, including the scoring algorithm, question bank, UI/UX, template report content, trademarks, and branding, are owned by us and protected by copyright, trade secret, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service during the term of your account.

4.2 Your Report Ownership

You retain ownership of your User Content. Upon purchase of a Report, we grant you a perpetual, non-exclusive, royalty-free license to use, reproduce, and distribute the Report for your internal business purposes. You may share your Report with consultants, board members, and investors, but may not resell, sublicense, or commercially exploit the Report.

4.3 User Content License

By submitting Assessment answers, you grant us a limited license to process your answers to compute your score and generate your Report. If you opt into the benchmark program, you grant us a license to include your anonymized scores in aggregate datasets. You represent that your submissions do not infringe any third-party rights.

4.4 Feedback

Any feedback, suggestions, or feature requests you submit may be used by us without compensation or attribution.

5. Prohibited Uses

You may not:

  • Reverse engineer, decompile, or attempt to extract the source code or scoring algorithm
  • Scrape, crawl, or systematically extract data from the platform
  • Sell, resell, or commercialize access to the platform or Reports without a white-label agreement
  • Submit false, misleading, or fabricated Assessment answers for the purpose of achieving a particular score
  • Use the platform to make fraudulent benchmark contributions
  • Impersonate another organization or person
  • Attempt to circumvent rate limiting, authentication, or any security measure
  • Use Assessment results to make hiring, firing, or employment decisions about individuals (the tool assesses organizational readiness, not individual performance)
  • Use the Service as a substitute for professional IT, legal, or strategic consulting advice
  • Use the platform in any manner that violates applicable law

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all implied warranties including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results obtained from the Service will be accurate or reliable.

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above limitations apply to the fullest extent permitted by applicable law.

7. Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Service or any Report, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or related to these Terms or your use of the Service will not exceed the greater of: (a) the total amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

These limitations reflect an allocation of risk and are an essential element of the agreement between you and ReadyPillar. Without these limitations, the fees charged would be substantially higher. These limitations apply even if any limited remedy fails its essential purpose.

Some jurisdictions do not permit the exclusion of certain damages. In those jurisdictions, liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless ReadyPillar, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your User Content; (c) your violation of any applicable law; (d) your infringement of any third-party rights; or (e) any representations you make to third parties about the accuracy or completeness of your Report.

9. Termination

9.1 Termination by You

You may delete your account at any time. Upon deletion, your data is erased per the retention schedule described in our Privacy Policy. Reports previously downloaded are not affected by account deletion.

9.2 Termination by ReadyPillar

We may suspend or terminate your account immediately, without notice, for: material breach of these Terms, fraudulent activity, prohibited use, or as required by law. We may terminate the Service entirely with 30 days' notice.

9.3 Effect of Termination

Upon termination, your license to use the platform ends and your account data is deleted per the retention schedule. You retain any Reports already downloaded. Sections that survive termination: Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.

10. Organization and Team Accounts

The account owner (the person who registered the organization account) is the designated administrator and is responsible for all activity under the account, including team members.

Assessment data generated under an organization account belongs to the organization, not to individual users. Upon an employee leaving the organization, the organization administrator controls data retention and access.

White-label resellers are responsible for their end users' compliance with these Terms and must communicate the AI-generated content disclaimer to their end users.

11. Dispute Resolution and Governing Law

11.1 Informal Resolution

Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@readypillar.ai. We will attempt to respond within 30 days.

11.2 Governing Law

These Terms are governed by the laws of the jurisdiction in which ReadyPillar is incorporated, without regard to conflict-of-law principles. For EU/UK users, mandatory consumer protection laws of your country of residence apply where they provide greater protections.

11.3 Jurisdiction

Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in the jurisdiction in which ReadyPillar is incorporated.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy and any applicable order forms, constitute the entire agreement between you and ReadyPillar.

12.2 Severability

If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary. The remainder of the Terms continue in full force and effect.

12.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of future enforcement of that or any other provision.

12.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets, with notice to users.

12.5 Force Majeure

Neither party is liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, government actions, infrastructure failures, and third-party service outages (including LLM provider outages).

12.6 Changes to Terms

We may update these Terms at any time. Material changes will be notified via email and/or in-app notification at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
